Cherokee Nation court takes action in Baby Veronica custody case
Source: Tulsa World, Okla. July 23--The hearing was kept secret until Monday, but Baby Veronica's biological father went before a Cherokee Nation court last week to have other family members declared joint guardians. In the middle of a custody battle with her adoptive parents in South Carolina, Dusten Brown had to leave Monday for mandatory Oklahoma National Guard training.Giving them the power to make legal and medical decisions for Veronica while he's out of state, the Cherokee court granted temporary guardianship to his wife, Robin Brown, and his parents, Tommy and Alice Brown. The tribal court order came just hours before the state Supreme Court of South Carolina decided last Wednesday to terminate Brown's parental rights and give Veronica back to the adoptive parents. The timing was coincidental, Cherokee officials said. But the tribe asked the South Carolina court to reconsider its decision."It makes a complicated case even more complicated," said Chrissi Nimmo, the tribe's assistant attorney general."If they move forward with a final adoption decree, it makes this a very messy, very complicated case."Nearly 4 years old now, Veronica has lived with her father in Nowata, an hour north of Tulsa, for the past 19 months. Her adoptive parents in South Carolina were making plans Monday to take custody of her again, even while a growing number of Indian groups were planning to stop them. If, or when, a South Carolina court officially transfers custody, the Native American Rights Fund promises to file a federal lawsuit on Veronica's behalf."We strongly believe," said the group's executive director, John Echohawk, "that her federal civil rights are being violated."A nonprofit law firm that concentrates on Indian rights, the Native American Rights Fund is teaming up with the National Congress of American Indians and the National Indian Child Welfare Association to intervene in the custody battle.Tribes nationwide see the case as a test of tribal sovereignty, setting a precedent for other adoptions.HOMEVeronica: Nearly 4 years old now, Veronica has lived with her father in Nowata for the past 19 months."The decision contributes to the long and sordid history of Native American children being removed from their families without any consideration of their best interests," said Jacqueline Pata, the executive director of the National Congress of American Indians.Brown, a member of the tribe, sought the Cherokee Nation's help after he realized that his former fiancee had placed their daughter for adoption.Born in September 2009, Veronica was 4 months old and already living with her adoptive parents in South Carolina when Brown, just a few days before deploying to Iraq, was served legal papers. He signed them, but he says he thought he was giving custody to the birth mother.Feeling tricked when he found out about the adoption, he sued. And with the Cherokee Nation's help, he won custody in December 2011.Last month, the U.S. Supreme Court ruled that the South Carolina judges had misinterpreted a federal law, the Indian Child Welfare Act of 19mini storage8.The federal law didn't necessarily give custody to the father based on his Cherokee heritage. But the U.S. Supreme Court's decision didn't automatically give custody to the adoptive parents, either. It simply meant that the South Carolina courts had to reconsider the case.Brown and the Cherokee Nation expected to go back to Family Court in South Carolina, where they could argue that Veronica was better off staying in Oklahoma.Instead, the South Carolina state Supreme Court decided in a 3-2 vote last week to finalize the original adoption as soon as possible, with no "best interest" hearing.A final court order could come as soon as this week to transfer custody back to Matt and Melanie Capobianco in Charleston, S.C., officials said Monday.Whenever it comes, the Native American Rights Fund plans to ask a federal district court in South Carolina to block it."There's nothing for us to file until the South Carolina order becomes final," said Richard Guest, a staff attorney for the group. "But we are prepared to file a lawsuit when needed."Two years ago, when granting custody to the biological father, South Carolina courts determined that it was in Veronica's best interest to be raised by her natural family in Oklahoma, said Terry Cross, the executive director of the National Indian Child Welfare Association."The legal system worked then, but it is being ignored now," Cross said. "Every child deserves to have his or her best interests considered."But the adoptive parents have a different interpretation of previous court rulings, saying the judges actually considered it best for Veronica to stay in South Carolina. They say the lower courts granted custody to the biological father only because the judges believed federal law mandated it -- a notion that the U.S. Supreme Court declared to be wrong."It was a mistake of law," said Lori Alvino McGill, an attorney for the birth mother, who has always sided with the adoptive parents."He doesn't have any legal basis to hold onto Veronica."It's hypocritical for the biological father and the tribe to want a best-interest hearing now, McGill said."It's the very thing they said wasn't necessary when they took her away from the Capobiancos after 27 months with them."The adoptive couple could get legal custody of Veronica within days, she said. They are planning a "smooth and gradual transition," perhaps with an extended stay in Oklahoma. And they will offer the Brown family visitation rights, making them a permanent part of Veronica's life, McGill said."Enough is enough," she said. "It is time for everyone in Oklahoma to sit down and act like adults and figure out the best way to transition Veronica back to her home."She accused the Cherokee Nation of "retroactively manufacturing" the joint guardianship."This is a shameful display of hubris on the part of the Cherokee Nation," she said.Michael Overall 918-581-8383michael.overall@tulsaworld.comCopyright: ___ (c)2013 Tulsa World (Tulsa, Okla.)

Foes fill meeting on Port of Vancouver oil plan
Source: The Columbian, Vancouver, Wash. July 23--In a high-stakes situation and under a national spotlight, Port of Vancouver commissioners are expected to take action this morning on a controversial proposal to build the largest oil terminal in the Pacific Northwest. They may delay a decision because of public safety and other concerns raised by opponents who packed the commissioners' hearing room Monday night and spilled into the lobby because there weren't enough seats. However, port managers are recommending Commissioners Jerry Oliver, Brian Wolfe and Nancy Baker approve what would amount to one of the largest financial arrangements in the history of the 100-year-old port. For perspective: The port anticipates operating revenues of $34 million this year. A lease deal with Tesoro Corp. and Savage Companies would bring $4.5 million annually to the port, or $45 million over the first 10 years of the lease. The companies' oil-by-rail plan would invest up to $100 million to build a 42-acre operation capable of handling as much as 380,000 barrels of crude per day. The companies say the project will generate an estimated 250 temporary construction jobs and up to 120 full-time positions, most of them hired locally.More than 90 people jammed the port's administrative office Monday night. Judging by hands raised in opposition and claps in support of speakers, attendees overwhelmingly opposed the crude oil facility. Opponents ranged from members of a Vancouver environmental group and a man who traveled from Southern Oregon to a professor from the University of Louisville. And Vancouver and Portland members of the national group Climate Parents presented commissioners with 14,000 signatures demanding they reject the plan by Tesoro and Savage. The commissioners' meeting started at 7 p.m., with port managers delivering a presentation that lasted past 8 p.m. Then people were invited to testify and to keep their remarks short. By 9 p.m. Monday, 15 people had urged commissioners to reject the Tesoro-Savage plan, and more were lined up to speak. Except for port staff,no one had spoken in favor of the oil terminal. Critics hammered away at the project on several fronts, including that it will increase the risk of oil spills, release toxics into the air and exacerbate global warming.Andy Mechling, who traveled from Southern Oregon to testify Monday night, urged commissioners to read material safety data sheets that he offered to provide them. They show that Bakken crude oil -- which the Tesoro-Savage plan would haul by rail through the Columbia River Gorge to the Port of Vancouver -- is "extremely flammable stuff," he said.Lease agreementMonday night's workshop gave the three commissioners an opportunity to review the potential elements of a lease with Tesoro and Savage. The review was broad. "Where's the lease?" one man yelled from the audience. Port managers told commissioners that public and environmental safety, accountability and social responsibility will be built into any agreement with the companies.Curtis Shuck, director of economic develomini storagement and facilities for the port, said the companies would have to agree to stringent rail and operation safety plans before the port would allow them to operate their facilities."But after you sign the lease," called out one attendee, interrupting Shuck. The comment underscored what many critics told commissioners Monday night: Don't rush a lease decision, and give more time for people to comment on the oil terminal plan.Shuck said the deal would be an economic boon for the port and the community, allowing the port to re-invest $30 million in further industrial development, and creating a ripple effect of 2,700 jobs, as well as $18.8 million in state and local tax revenue annually.Karen Axell of the Rosemere Neighborhood Association, an environmental group, questioned the port's economic numbers and said the port's $25 million in pollution legal liability is "pitifully low." Referring to the July 6 deadly oil train derailment in Lac-Megantic, Quebec, Axell told commissioners to "ask the people of Quebec what they think" of the port's liability insurance. The calamity in Lac-Megantic vaporized a large swath of the downtown, killed 50 people, forced the evacuation of 2,000 and prompted investigations. And it loomed large at the port Monday evening. About an hour before the commission's 7 p.m. hearing, more than 30 opponents of the oil terminal gathered outside the port's administrative building to hold a vigil honoring the victims of the catastrophe in Lac-Megantic.State approval neededIn addition to requiring a lease deal from port commissioners, the plan by Tesoro and Savage would have to clear an examination by the state Energy Facility Site Evaluation Council, which would make a recommendation to Gov. Jay Inslee, who has the final say.The council's review could take up to a year or more. The companies hope to launch the terminal in 2014.Tesoro and Savage would bring oil by train from the Bakken shale formation in North Dakota, where oil is extracted by hydraulic fracturing. The oil would be stored and later transferred to vessels for shipment to U.S. refineries. The crude oil operation would initially add one to two unit trains per day. That would increase to four unit trains per day once the operation hits its peak. The oil-bearing trains would run through the Columbia River Gorge and close to downtown Vancouver.Tesoro and Savage have said they'll implement a safe oil-handling plan, including deployment of state-of-the-art, double-hulled marine vessels and rail cars.Investigators in Canada are examining what led to the explosion after the derailment in Lac-Megantic, Quebec, according to the Globe and Mail newspaper. Citing industry sources, the newspaper said one possibility is whether the crude, hauled from the Bakken site, contained volatile chemicals.Aaron Corvin: http://twitter.com/col_econ; http://on.fb.me/AaronCorvin; 360-735-4518; aaron.corvin@columbian.comCopyright: ___ (c)2013 The Columbian (Vancouver, Wash.) Lake County website experienced recent outages
Source: Chicago TribuneJuly 23--Lake County residents may have had some problems last week with online tasks such as paying bills, applying for marriage licenses or registering to vote after the county's website experienced some technical difficulties, county officials said. What officials originally thought was a software problem actually turned out to be a piece of failed hardware, according to Kirk Talbott, chief information officer for the county. When a software update was applied in an attempt to fix the issue, it "ended up breaking things worse," Talbott said, resulting in the problems.Parts of the system were brought back online throughout the day, and everything was up and running by the evening of July 17, he said.Officials had worked around the clock the night before trying to address the issue, County Clerk Willard Helander said. The problem was particularly hard to diagnose, Talbott said, because the hardware only partially迷你倉價錢failed. Normally, he said, when systems fail, they switch over to a secondary unit, but that didn't happen in this case."Once we found it was bad, we turned it off," he said.Talbott said beyond bills, access to the assessor's office and voter registration, he also was aware of issues with filing court applications and records."I can't say any department over another was harder-hit," Talbott said. "Some departments are more dependent than others with public-facing systems."The county has data backups for any system that has an effect on citizens, Talbott said, to prevent further issues. He said residents' data was not affected by the interruption in service. All services remained available to residents who came in person to the county building, 18 N.
